Terms & Conditions

Last updated: 30 July 2026

1. Scope and Service Provider

These Terms & Conditions apply to all photography services, quotations, assignments and contracts provided through or in connection with MPOUKALAFOTOS.

The service provider is:

MPOUKALAFOTOS
Aleš Borszék
Mythimnis Street 0
734 00 Drapanias, Kissamos
Greece

Telephone: +30 698 917 0890
Email: office@mpoukalafotos.gr
Website: www.mpoukalafotos.gr

These Terms & Conditions apply to both business customers and consumers. Mandatory consumer-protection rights remain unaffected.

2. Services

MPOUKALAFOTOS provides professional bottle and product photography, including:

  • Standard Bottle Photography
  • Creative Advertising Photography
  • Image retouching and colour correction
  • Transparent-background product images
  • Other individually agreed photography and image-production services

The exact scope of each assignment is determined by the customer’s request, the selected options, any written quotation and any additional written agreement.

3. Standard Bottle Photography

Standard Bottle Photography consists of clean, professionally lit and retouched bottle images produced according to the standardised visual style offered by MPOUKALAFOTOS.

Customers may select from the available reflection and lighting styles. The fundamental setup, image composition and production method remain standardised and may also be used for other customers and brands.

Unless otherwise agreed in writing, the delivered images are provided as:

  • PNG or WebP files
  • Approximately 2000 × 2000 pixels
  • Transparent background
  • Professionally retouched and colour-corrected

4. Creative Advertising Photography

Creative Advertising Photography is individually planned and priced according to the number of products, complexity, styling, backgrounds, props, lighting, production time and intended use.

Prices shown for Standard Bottle Photography do not apply to Creative Advertising Photography.

Creative work begins only after the customer has accepted a written quotation or individual project agreement. MPOUKALAFOTOS may require an advance payment before purchasing materials, booking production time or beginning the assignment.

5. Prices and VAT

Unless expressly stated otherwise, all prices displayed on the website or quoted to customers are net prices and exclude Greek Value Added Tax.

Standard Bottle Photography is currently offered from:

€35.00 net per bottle, plus 24% VAT.

At the current VAT rate, €35.00 net corresponds to €43.40 including 24% VAT.

There is no general minimum number of bottles and no general minimum order value.

Additional services, special requests, complex retouching, label removal, shipping, props, materials and other separately agreed expenses are charged additionally.

6. Requests, Quotations and Formation of Contract

Submitting a request through the website does not automatically create a binding contract.

The information submitted through the request form is used to review the project and, where necessary, provide instructions, confirm availability or prepare an individual quotation.

A binding contract is formed when:

  • MPOUKALAFOTOS expressly accepts the assignment in writing;
  • the customer accepts a written quotation;
  • the customer expressly instructs MPOUKALAFOTOS to proceed; or
  • MPOUKALAFOTOS begins the agreed work with the customer’s knowledge and approval.

Email and other reproducible written electronic communication are sufficient for contractual communication.

7. Customer Responsibilities

The customer must provide accurate and complete information regarding the requested service, number of products, desired visual style, delivery arrangements and intended use of the images.

The customer is responsible for ensuring that:

  • the products are legally owned or may lawfully be supplied for photography;
  • all necessary permissions have been obtained;
  • the bottles and packaging are clean and in suitable photographic condition;
  • labels are correctly positioned and free from avoidable damage;
  • the products are safely and adequately packaged for transportation;
  • all relevant instructions are provided before photography begins.

MPOUKALAFOTOS is not responsible for delays or additional work caused by incomplete, inaccurate or subsequently changed instructions.

8. Bottle Preparation and Rear-Label Removal

Where the selected photography style requires the removal of a rear label, barcode label, sticker or other visible element, the customer is responsible for removing it before sending or delivering the bottle.

If the customer sends a bottle without the required label removal, MPOUKALAFOTOS may remove the label at the following price:

€7.00 net per label, plus 24% VAT.

Label removal may involve heat, moisture, cleaning products, blades or other appropriate tools. The customer acknowledges that removal may damage the label, adhesive surface, coating, print, bottle, packaging or surrounding material.

MPOUKALAFOTOS accepts no liability for unavoidable damage caused during label removal, except where damage results from intentional misconduct or gross negligence.

Removed labels may be discarded unless their return has been expressly agreed before the work begins.

9. Delivery of Products to MPOUKALAFOTOS

The customer bears all costs and risks associated with sending or transporting bottles and other products to MPOUKALAFOTOS.

The customer is responsible for selecting appropriate packaging and a suitable postal, courier or transport provider.

Risk remains with the customer until the shipment has been physically received by MPOUKALAFOTOS.

MPOUKALAFOTOS is not responsible for loss, leakage, temperature damage, breakage, delay, customs issues or other damage occurring before receipt.

The customer must comply with all shipping restrictions that apply to liquids, alcohol, glass containers, pressurised products, hazardous substances or other regulated contents.

10. Handling of Bottles and Products

Bottles and products may need to be unpacked, cleaned, repositioned, opened, supported, temporarily fixed, chilled, warmed, sprayed, polished or otherwise handled as reasonably required for photography.

The customer acknowledges that commercial product photography involves ordinary handling risks, including scratches, broken seals, label damage, leakage, breakage, contamination or loss of contents.

MPOUKALAFOTOS will handle products with reasonable professional care but does not guarantee that bottles, labels, packaging, seals or contents will remain in their original saleable condition.

Products supplied for photography should therefore not be unique, irreplaceable or of exceptional value unless this has been disclosed and expressly accepted in writing before delivery.

11. Return, Collection or Disposal of Products

The customer must select or agree what should happen to the products after photography.

Available arrangements may include:

  • collection by the customer;
  • return by post or courier at the customer’s expense; or
  • disposal or recycling, where expressly selected or agreed.

The customer bears all costs and transport risks associated with the return shipment.

Return shipping must be paid in advance. MPOUKALAFOTOS is not obliged to dispatch a return shipment until all shipping costs and outstanding invoices have been paid in full.

MPOUKALAFOTOS may select a reasonable postal or courier provider unless a particular provider has been agreed in writing.

Risk passes back to the customer when the properly addressed return shipment is handed over to the postal, courier or transport provider, to the extent legally permissible. Mandatory consumer rights remain unaffected.

Products that are not collected and for which return shipping has not been paid may be stored for up to 30 calendar days after the customer has been informed that the assignment is complete.

After this period, MPOUKALAFOTOS may dispose of or recycle the products after giving the customer a final reasonable opportunity to arrange collection or return.

12. Production Times

The expected production time for Standard Bottle Photography is normally:

  • 1–9 bottles: approximately 3–4 working days;
  • 10 or more bottles: approximately 5–7 working days;
  • very large assignments: according to an individually agreed schedule.

Production time normally begins after:

  • all products have been received;
  • all necessary instructions have been supplied;
  • the assignment has been accepted;
  • any requested advance payment has been received; and
  • any applicable consumer withdrawal requirements have been satisfied.

Production times are estimates unless a binding delivery date has been expressly confirmed in writing.

Delays caused by product condition, incomplete information, changed instructions, illness, technical failure, force majeure, courier delays or circumstances outside the reasonable control of MPOUKALAFOTOS do not constitute default.

13. Proofs, Corrections and Revision Round

One reasonable correction round is included in the agreed price.

The included correction round may cover reasonable adjustments such as:

  • minor colour corrections;
  • brightness or contrast adjustments;
  • minor retouching corrections; and
  • correction of an objectively identifiable processing error.

The included correction round does not include:

  • a complete reshoot;
  • a different reflection style selected after photography;
  • a different bottle position or composition;
  • replacement of products supplied in unsuitable condition;
  • new instructions introduced after production;
  • complex image manipulation not included in the original assignment; or
  • changes based solely on a change of personal preference after approval.

Additional corrections, retouching or reshoots may be charged separately.

14. Inspection and Notification of Issues

Customers should inspect delivered image files promptly and notify MPOUKALAFOTOS of any visible technical error or deviation from the agreed assignment as soon as reasonably possible.

Business customers should report visible issues in writing without undue delay after delivery and should provide a clear description of the alleged issue.

Failure to report a visible issue promptly may make later investigation or correction more difficult.

This clause does not exclude, reduce or replace any mandatory statutory rights available to consumers.

15. Invoicing and Payment

Unless otherwise stated in a quotation or individual agreement, MPOUKALAFOTOS may issue the invoice after completion of the photography and editing work.

Invoices are generally payable within 7 calendar days from the invoice date, without deduction.

MPOUKALAFOTOS may provide watermarked or reduced-resolution preview images before payment. Final high-resolution image files without watermarks may be withheld until all outstanding amounts have been paid in full.

The customer is not entitled to use, publish, reproduce or distribute preview files.

For Creative Advertising Photography, larger assignments, new customers, international assignments or projects requiring external expenses, MPOUKALAFOTOS may require:

  • full advance payment;
  • a partial advance payment;
  • payment of external costs in advance; or
  • payment before final image delivery.

Bank fees, currency-conversion fees and other payment costs charged to the customer are borne by the customer.

In the event of late payment, MPOUKALAFOTOS may suspend delivery, further corrections, licensing and other work and may claim any interest or recovery costs permitted by law.

16. Delivery of Image Files

Image files are normally delivered electronically using email, a download link, cloud transfer or another agreed digital method.

Delivery is deemed completed when the files or functioning download link have been sent to the email address or contact method supplied by the customer.

The customer is responsible for downloading, checking and securely backing up the delivered files.

MPOUKALAFOTOS does not guarantee permanent archival storage of completed files.

17. RAW Files and Working Files

RAW files, unedited photographs, layered files, project files, masks, working files, Photoshop files and other production materials are not included and will not be delivered.

Only the final edited image files expressly included in the assignment are delivered to the customer.

18. Copyright and Usage Rights

Aleš Borszék remains the photographer and author of the photographs to the extent provided by applicable copyright law.

After full payment, the customer receives a broad, non-exclusive, worldwide and unlimited-duration commercial right to use the final delivered Standard Bottle Photography images for the customer’s own business, products and brand.

This includes use for:

  • websites and online shops;
  • online marketplaces;
  • social media;
  • digital and printed advertising;
  • catalogues, menus, brochures and price lists;
  • packaging and point-of-sale materials;
  • public relations and editorial brand communication; and
  • other lawful commercial promotion of the photographed products.

The customer may crop, resize, add text, integrate the images into layouts and make reasonable technical adaptations necessary for the permitted uses.

Unless expressly agreed otherwise, the customer may not:

  • sell or license the photographs as standalone stock images;
  • claim authorship of the photographs;
  • register the photographs themselves as independent intellectual property;
  • use the images unlawfully, deceptively or in a defamatory context; or
  • provide the images to unrelated third parties for products or brands not covered by the assignment.

Agencies, designers, printers, marketplaces and other service providers may receive and process the images on the customer’s behalf for the permitted purposes.

Usage rights do not become effective until the relevant invoice has been paid in full.

19. Portfolio and Self-Promotional Use

Unless the customer objects in writing before the final images are delivered, MPOUKALAFOTOS may display the completed photographs for its own legitimate self-promotional purposes.

This may include:

  • the MPOUKALAFOTOS website and portfolio;
  • social-media profiles and posts;
  • printed promotional material;
  • presentations and sample galleries; and
  • advertisements promoting MPOUKALAFOTOS photography services.

MPOUKALAFOTOS will not sell or license the customer’s completed product photographs to third parties as standalone images.

Where the customer informs MPOUKALAFOTOS that the products, packaging or campaign are confidential or subject to an embargo, the images will not be published before the agreed release date.

The customer may object to portfolio use by sending an email to: office@mpoukalafotos.gr.

20. Similar Setups and Non-Exclusivity

Standard Bottle Photography is based on repeatable professional lighting, positioning, retouching and reflection techniques.

Unless exclusivity is expressly agreed in writing and separately priced, the customer does not receive exclusive rights to:

  • the lighting setup;
  • the reflection style;
  • the background treatment;
  • the photography method;
  • the composition concept; or
  • the general visual style.

MPOUKALAFOTOS may use similar techniques and setups for other customers, including customers operating in the same industry.

21. Customer-Supplied Rights and Materials

The customer confirms that it holds all rights and permissions required for any logos, labels, designs, graphics, reference images, instructions or other materials supplied to MPOUKALAFOTOS.

The customer is responsible for claims arising from materials or instructions supplied by the customer where their use infringes third-party rights.

Reference images are used only as visual guidance. MPOUKALAFOTOS is not obliged to reproduce another photographer’s or creator’s protected work exactly.

22. Cancellation by the Customer

Subject to any mandatory consumer withdrawal rights, the customer may cancel an assignment free of charge before MPOUKALAFOTOS has begun work and before external costs have been incurred.

Once work has begun, the customer must pay for:

  • all work already performed;
  • photography or editing already completed;
  • reserved production time where it cannot reasonably be reassigned;
  • materials, props and services already purchased;
  • non-refundable third-party expenses; and
  • other costs reasonably incurred for the assignment.

Advance payments may be retained to cover work performed and costs incurred. Any remaining refundable balance will be returned where legally required.

23. Cancellation or Postponement by MPOUKALAFOTOS

MPOUKALAFOTOS may suspend, postpone or cancel an assignment where performance becomes impossible or unreasonable due to illness, accident, technical failure, unsafe products, unlawful instructions, non-payment, force majeure or another circumstance outside reasonable control.

Where MPOUKALAFOTOS permanently cancels an assignment without providing the agreed service, amounts paid for unperformed work will be refunded. Further claims are limited to the extent permitted by law.

24. Consumer Right of Withdrawal

This section applies only where the customer is a consumer and the contract is concluded at a distance or away from the business premises.

A consumer generally has the right to withdraw from a distance service contract within 14 calendar days without giving a reason.

The withdrawal period begins on the date the service contract is concluded.

To exercise the right of withdrawal, the consumer must inform MPOUKALAFOTOS of the decision to withdraw by means of a clear statement sent to:

MPOUKALAFOTOS
Aleš Borszék
Mythimnis Street 0
734 00 Drapanias, Kissamos
Greece
Email: office@mpoukalafotos.gr

The consumer may use the model withdrawal form provided below, but use of the form is not mandatory.

25. Request to Begin Work During the Withdrawal Period

Because the standard production period may be shorter than 14 days, a consumer who wants work to begin before the withdrawal period has expired must expressly request the early commencement of the service.

If the consumer withdraws after expressly requesting that work begin, the consumer may be required to pay a proportionate amount for the services already provided up to the time of withdrawal.

The right of withdrawal may expire once the service has been fully performed, provided that performance began with the consumer’s prior express consent and acknowledgement that the right of withdrawal would be lost after full performance.

Nothing in these Terms removes mandatory consumer rights where the legal requirements for early performance or loss of the withdrawal right have not been satisfied.

26. Model Withdrawal Form

Complete and return this form only if you wish to withdraw from the contract:

27. Liability

MPOUKALAFOTOS is liable without limitation where liability cannot legally be excluded, including for intentional misconduct, gross negligence and any other mandatory legal liability.

In cases of ordinary negligence, liability is limited to reasonably foreseeable damage resulting from the breach of an essential contractual obligation, to the extent permitted by law.

To the extent permitted by law, MPOUKALAFOTOS is not liable for:

  • damage occurring during transportation arranged by the customer;
  • ordinary wear or unavoidable damage caused by reasonable product handling;
  • pre-existing defects, scratches, label damage or packaging defects;
  • colour differences caused by uncalibrated displays, printers or third-party platforms;
  • losses caused by inaccurate or incomplete customer instructions;
  • indirect loss, lost profit or loss of business opportunity;
  • third-party platform changes, compression or image-processing behaviour;
  • failure by the customer to download or back up delivered files; or
  • events outside the reasonable control of MPOUKALAFOTOS.

Mandatory rights and remedies available to consumers remain unaffected.

28. Colour Accuracy and Display Differences

MPOUKALAFOTOS uses professional equipment and reasonable colour-management practices. However, exact colour reproduction cannot be guaranteed on every device, browser, display, printer, substrate or third-party platform.

Differences may result from screen calibration, brightness settings, colour profiles, compression, printing methods, paper, inks and platform-specific processing.

29. Data Protection

Personal data is processed in accordance with the Privacy Policy published on MPOUKALAFOTOS.gr.

The Privacy Policy forms part of the website’s legal information and should be read together with these Terms & Conditions.

30. Governing Law and Jurisdiction

These Terms & Conditions and all contracts with MPOUKALAFOTOS are governed by the laws of Greece, excluding conflict-of-law rules to the extent permitted.

For contracts with business customers, the courts having jurisdiction for the registered business location of MPOUKALAFOTOS shall have jurisdiction, unless another place of jurisdiction is required by mandatory law.

Consumers retain the protection of any mandatory provisions of the law of the country in which they habitually reside and may use any court jurisdiction available to them under applicable consumer law.

31. Contract Language

The contractual language is English.

Translations may be provided for convenience. In the event of a discrepancy between language versions, the English version applies to the extent legally permissible. Mandatory consumer rights remain unaffected.

32. Amendments and Individual Agreements

Individual written quotations and project agreements take precedence over these Terms & Conditions where they expressly contain different provisions.

MPOUKALAFOTOS may update these Terms & Conditions for future assignments. The version provided or available when the relevant contract is concluded applies to that contract.

33. Severability

If any provision of these Terms & Conditions is invalid, unenforceable or inapplicable, the remaining provisions remain in effect.

The invalid provision shall be replaced by the applicable statutory provision or interpreted as closely as legally possible to its intended commercial purpose.
